Appeals

(Civil Appeals for both Federal and State Courts)

James, House, Swann & Downing, P.A. has extensive experience drafting appellate briefs and has orally argued before Federal and State courts on many occasions. The Firm has handled appeals in many venues, including but not limited to the Arkansas Supreme Court, the Arkansas Court of Appeals, the Eighth Circuit Court of Appeals, the United States Court of Appeals for the Federal Circuit, and the United States Supreme Court. Frequently, our firm has stepped in at the appellate court level after clients were unsuccessful at the trial court level with different attorneys.

Our attorneys are well-versed in the types of logical, compelling arguments anticipated by appellate courts and will work closely with both the client and trial counsel to understand the primary issues on appeal. If retained before trial, we will strive to preserve issues so that they can be properly appealed at the next level if necessary. We provide representation and advice on a wide variety of appellate matters, whether your desire is to reverse an unfavorable judgment or to protect a favorable judgment from reversal.

The trial process involves the initial persuasion of the judge and jury based on the evidence and legal arguments. The appellate process is different in that the parties seek to persuade a panel of judges as to the correctness of their positions relating to legal issues that arise from the trial judge’s rulings or the sufficiency of the evidence. Appellate practice is different from trial litigation, and practitioners who are well-versed in this area are necessary for a successful appeal.
